Directive 2009/136/EC aims to strengthen the protection of internet users’ personal data. For this reason, the EU distinguishes between technical cookies and profiling cookies:

• Technical cookies can be installed immediately (i.e., without prior user consent);

• Profiling cookies, however, require prior consent.

This means the EU regulation requires an opt-in solution for non-essential cookies.

The main difference between opt-out and opt-in:
